Fight back against discriminatory treatment for HIV/AIDS

If you are suffering with a diagnosis of HIV or AIDS, you are likely already facing myriad challenges that can affect multiple areas of your life. One issue you may face is discriminatory treatment from your Florida employer because of your medical diagnosis. Victims of discrimination on the basis of their illness have the right to fight back.

The Americans with Disabilities Act states that employers cannot act in a discriminatory manner against individuals with a disability. This can include HIV or AIDS. This means that your medical condition cannot be a determining factor in your job security, pay and career opportunities.

Are you a victim?

Under the ADA, a person with a disability has the right to work. If you are physically capable of working, you have the right to seek employment, the advancement of your career and opportunities to earn a living. If you are a person living with HIV or AIDS and concerned about your employment rights, consider the following facts:

  • HIV and AIDS qualify as disabling medical conditions because of the significant impact they can have on your immune system. This means you have the protection of the ADA.
  • Even with a disability, you have the right to work as long as you can meet the demands of the job.
  • The ADA requires employers to provide reasonable accommodations for individuals with disabilities in the workplace.
  • Under the ADA, there are strict limits to what an employer can ask you regarding your medical condition, treatments and prognosis.

You also have additional rights, including the right to privacy and more. If you have concerns about your rights or believe that you are the victim of illegal treatment or discrimination, you do not have to face it alone. Victims of discrimination can fight back and hold employers liable for mistreatment in the workplace.

Fight back and protect your rights

It is difficult and disheartening when you experience discriminatory treatment in the workplace. You do not have to face it alone, but you can speak up for yourself and your interests by seeking assistance as soon as possible.

As a victim of employment discrimination on the basis of AIDS or HIV, you may have a right to a legal claim against your employer. A complete evaluation of your case can help you understand your legal options and identify the most appropriate course of action for you at this time.
